Terms of Service
Last updated: August 22, 2026
These Terms of Service (Terms) govern access to and use of the Hostnest platform and related services provided by Sprint di Linguari Stefano (Hostnest, we, us). By using the platform, the hospitality business (Property, Customer, or you) agrees to these Terms. If you do not agree, you must not use the service.
1. Service provider
The service is provided by Sprint di Linguari Stefano, Largo Piave 11, 28066 Galliate (NO), Italy, VAT ID 08001990962, PEC sprint@mypec.eu, email info@hostnest.it.
2. Definitions
For the purposes of these Terms:
- Property — contracting hospitality business using Hostnest to manage requests, quotes, and bookings.
- Authorized user — natural person enabled by the Property to access the backoffice.
- Guest — end customer or prospect interacting with the public customer area or submitting stay requests.
- Quote — personalized commercial proposal with one or more options (multi-proposal).
- Deposit — advance amount requested by the Property before or upon booking confirmation.
- Management commission — Hostnest's variable fee on online payments processed through the platform, as per Economic Conditions.
- Stripe Connect — Stripe integration for onboarding and payments on the Property's linked account.
- DPA — Data Processing Agreement for processing performed by Hostnest on behalf of the Property.
- Contractual documents — Terms, Economic Conditions, Payment Conditions, Booking Conditions, DPA, and applicable schedules.
3. Nature of the service
Hostnest is software designed for hospitality businesses to support the operational flow from stay request to quote, customer selection, availability confirmation, deposit, and booking.
Hostnest is not, and does not represent itself as:
- a complete property management system (PMS);
- a channel manager (CM);
- an online travel agency (OTA);
- a marketplace or intermediary booking platform where Hostnest acts as contracting party for the stay.
Hostnest provides technical tools and does not replace the Property's operational, commercial, tax, or legal organization. The Property remains responsible for its hospitality activity, published information, contractual terms offered to guests, and compliance with applicable sector regulations.
Hostnest does not currently use artificial intelligence features to automatically generate quotes, pricing, or guest responses. AI features may be introduced in future with dedicated notice and acceptance where required.
4. Relationship between Property and guest
The contractual relationship relating to the stay, proposed commercial terms, deposit, balance, cancellations, refunds, and every obligation toward the guest is established exclusively between the Property and the guest. Hostnest is not a party to that relationship, does not act as the guest's booking agent, and does not guarantee actual room or unit availability except as recorded in the system based on actions taken by the Property.
The Property is responsible for providing guests with accurate information, clear terms, contractual documentation, and privacy notices compliant with its role as data controller.
5. Accounts, access, multi-Property, and Property obligations
To use Hostnest, the Property must create an account, provide accurate and up-to-date information, designate authorized users, and safeguard access credentials. The Property is responsible for all activity performed through its account and for ensuring authorized users comply with these Terms and applicable law.
Where contractually enabled, Hostnest may support management of multiple hospitality businesses (multi-Property) linked to the same account or group, with logical data segregation. The Property remains responsible for correct tenant configuration, user permissions, and operational separation between businesses. Hostnest does not audit the Property's internal authorization policies.
The Property agrees to use the platform lawfully, professionally, and consistently with the service purpose, refraining from abusive, fraudulent, harmful, or system-evading conduct.
The Property must promptly notify Hostnest of suspected unauthorized access or credential compromise and take reasonable steps to revoke compromised user access pending investigation.
6. Availability and bookings
Hostnest does not automatically block room or unit inventory and does not guarantee alignment with other sales channels or external systems. Availability confirmation is a manual action by the Property within the product workflow. The Property is responsible for verifying actual availability before confirming a proposal or proceeding to booking.
Hostnest does not guarantee that a booking automatically assigns a specific physical unit, nor that operational overlaps will not occur if the Property fails to manage availability correctly inside or outside the system.
7. Payments through Stripe (V1 — online card only)
Where the Property enables Stripe Connect integration, deposit payments may be processed through Stripe-hosted checkout on the Property's linked account. Stripe operates as an independent payment service provider under its own terms. Hostnest does not store full card details.
In the V1 product version:
- online payment of the deposit is supported via card (and methods enabled by Stripe Checkout on the Property's account);
- online payment of the remaining balance through Hostnest is not supported;
- integrated or Hostnest-recorded bank transfer as a payment method is not supported;
- balance, cash, non-integrated POS, and other offline payments remain exclusively managed by the Property.
The Property is responsible for completing Stripe onboarding, maintaining a compliant account, and using payment features lawfully. Hostnest may suspend payment functionality in case of technical anomalies, state misalignment, or breach of these Terms.
8. Fees and management commission
Unless otherwise agreed in writing, Hostnest does not charge a fixed monthly subscription for use of the platform in the current product version. Hostnest may apply a variable management commission on payments processed through Hostnest, calculated according to economic conditions made available separately (Economic Conditions).
These Terms and this document do not set numeric percentages or amounts for the commission: applicable values are communicated or made available in the accepted offer, backoffice, or specific commercial documentation. Rates or amounts may change over time as contractually provided.
Stripe fees and any payment service costs are separate and borne by the Property under Stripe terms. If a payment is refunded, the Hostnest management commission is not returned, unless otherwise agreed in writing or required by mandatory law.
9. Refunds and chargebacks
In V1 Hostnest does not expose a refund interface in the backoffice. Deposit refunds must be performed by the Property through the Stripe Dashboard. Hostnest synchronizes payment status via webhooks; the booking is not automatically cancelled following a refund.
Chargebacks and guest disputes are handled by Stripe under its procedures. The Property is responsible for required documentation and the relationship with the guest. Hostnest does not guarantee favorable chargeback outcomes or replace commercial or legal dispute handling.
10. Acceptable use
The Property agrees not to use Hostnest to:
- conduct unlawful, misleading, or non-compliant activity under tourism, tax, privacy, or consumer law;
- send spam or upload offensive, discriminatory, or third-party-rights-infringing content;
- upload malware, attempt unauthorized access, perform unpermitted reverse engineering, or interfere with infrastructure;
- use the service for purposes other than those intended, including unauthorized resale or use as a base for unlicensed competing services;
- process personal data in breach of GDPR, the Hostnest-Property DPA, or notices provided to guests;
